This resolution authorizes the preparation and execution of a License Agreement by the proper City officials for the development of a bicycle and pedestrian trail in the Menomonee Valley. This resolution also authorizes the Commissioner of the Department of City Development, with the assistance of the City Attorney's Office, to draft a License Agreement in accord with the terms listed herein.
BODY:
Whereas, CMC owns property along the Menomonee River in the Menomonee Valley; and

Whereas, CMC has generously agreed in principle to grant the City an indefinite license to establish a bicycle and pedestrian trail generally along the south bank of the river from a point east of South 27th Street to Miller Park; and

Whereas, The City seeks to offer its citizens recreational opportunities and access to public waterways; and

Whereas, The License Agreement will not require compensation from the City to CMC; and

Whereas, The License Agreement will provide for indefinite use by the City, subject to termination if the City abandons the trail; and

Whereas, The trail may be used by bicyclists and pedestrians and not by motorized vehicles; and

Whereas, The Common Council of the City of Milwaukee desires to enter into a License Agreement with CMC for the development, operation and maintenance of said bicycle and pedestrian trail in the Menomonee Valley; now, therefore, be it
