This substitute resolution allows the con- struction of a building over a sanitary sewer in an easement and the conveyance of a storm sewer to the property owner.


BODY:
Whereas, On July 29, 1952, North 77th Street between vacated West Fairview Avenue and West Stevenson Street was vacated and now is part of the parcel of land known as 135 North 76th Street, having Tax Key Number 407-0501-110, and owned by the Archdiocese of Milwaukee; and

Whereas, No sewer easement document was pre- pared for the sanitary and storm sewers which are located in the vacated street; and

Whereas, The Archdiocese of Milwaukee has now requested permission to construct a building over the existing sewers located within the vacated street; and

Whereas, The Archdiocese will grant the City of Milwaukee a sewer easement for the sanitary sewer located within the vacated street; and

Whereas, The City will allow the construction of said building over a portion of said easement subject to reasonable conditions, which are necessary to protect the City's interests; and

Whereas, The City no longer requires the storm sewer in the vacated portion of North 77th Street for public use and the sewer can be conveyed to the Archdiocese; and

Whereas, The Archdiocese has deposited $100 for the remaining useful life of the storm sewer; now, therefore, be it
