- ANALYSIS - This resolution approves an Out-of-Program Agreement between the City of Milwaukee and Home Depot U.S.A., Inc. The company plans to construct a Home Depot building center at 4155 North Port Washington Road. Public water main improvements are needed to support the project. Home Depot will fund the entire cost of these improvements. Home Depot will also design the improvements, subject to City review and approval, and contract for their construction. City staff will provide inspection services.
BODY:
Whereas, Home Depot U.S.A., Inc. plans to construct a building products retail store at 4155 North Port Washington Road; and
Whereas, Public water main improvements are needed to support the project; and
Whereas, Home Depot will fund the entire cost of the needed water main improvements; and
Whereas, An Out-of-Program Agreement between Home Depot and the City of Milwaukee has been prepared and is included in the file; and
Whereas, The agreement outlines the terms and conditions under which Home Depot and the City of Milwaukee will cooperate to complete the needed water main improvements; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement between Home Depot U.S.A., Inc. and the City of Milwaukee is hereby approved; and, be it
Further Resolved, that the Commissioner of Public Works is authorized to make minor non-substantive changes to the Out of Program Agreement prior to its execution.
