Title:

Analysis:

This resolution authorizes the cancellation of a claim against Gerald F. Dietsche in connection with a motor vehicle accident.

BODY:

Whereas, A motor vehicle accident occurred on January 25, 2005 at South 27^th Street and West Forest Home Avenue between a City of Milwaukee squad car and a vehicle operated by Gerald F. Dietsche; and

Whereas, The City filed suit against Gerald F. Dietsch for its damages, at which time Gerald F. Dietsche filed a counterclaim against the City; and

Whereas, Discovery revealed that liability was approximately split between the parties; and

Whereas, The damages sustained by Gerald F. Dietsche totaled $11,651.00 and the damages sustained by the City totaled $10,329.00, now, therefore be it

Resolved, By the Common Council of the City of Milwaukee that the City Attorney be and hereby is authorized and directed, on behalf of the City, to cancel and release the invoice against Gerald F. Dietsche in the amount of $10,329.00 and to execute and deliver any necessary stipulations and releases to effectuate this release.
