Analysis:

This resolution authorizes the cancellation of demolition costs of $29,304.14 for the property located at 620 North 26^th Street, Milwaukee, Wisconsin.

Body:

Whereas, The property located at 620 North 26^th Street, Milwaukee, Wisconsin was the subject of a condemnation order from the City of Milwaukee Department of Neighborhood Services; and,

Whereas, The raze order was previously deemed reasonable and the City of Milwaukee put the demolition out for bids and accepted the low bid of $29,304.14 including added costs; and

Whereas, The property owner was invoiced for this amount and after a failure to pay was the subject of collection efforts by the Kohn Law Firm on behalf of City of Milwaukee to collect the demolition costs; Circuit Court Case No: 01CV000740; and

Whereas, The City of Milwaukee, through the Office of the City Attorney, has been unable to enforce collection of the demolition costs and deems it uncollectable due to the defendant's economic circumstances; and

Whereas, That the parties reached an agreement wherein the property owner will pay the city $5,000 as settlement of demolition and razing expenses of $29,304.14; and

Whereas, A Stipulation and Order was filed on June 25, 2002 and signed by the Honorable Thomas Cooper on July 8, 2002; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, to withdraw the invoice for $29,304.14 against the property at 620 North 26^th Street and accept a settlement payment of $5,000 in which the defendant shall pay within 30-days of receiving written notice and said approval.
