Analysis

This resolution authorizes settlement of the lawsuit entitled Robert Mercado v. City of Milwaukee, et al., U.S. District Court Case No. 2025CV00973 for the total amount of $95,000.00.

Body

Whereas, Plaintiff, Robert Mercado have filed a federal civil rights lawsuit against the City of Milwaukee, David Bettin, Joseph De La Vega, Jeremy Shelley, Kylie Spence and Eric Stewart.

 

Whereas, Counsel for the parties have reached an agreement to settle the above-referenced lawsuit for a total amount of $95,000.00 subject to approval by the Common Council; and

 

Whereas the City Attorney recommends and the Common Council of the City of Milwaukee deem it expeditious and just to settle this lawsuit; now, therefor be it

 

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers be and hereby authorized and directed to issue a City check in the amount of $95,000.00 payable to the order of Strang Bradley, LLC at 613 Williamson Street, Suite 204, Madison, WI 53703, as soon as practicable, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and be it

 

Further Resolved, that for and in consideration of the above- referenced payments, the Plaintiff, by his representative, and his attorneys, will provide to the City a release of any and all claims arising out of or in any way related to this incident.
