This resolution directs the Intergovernmental Relations Division - Department of Administration to seek passage of state legislation to permit booting or towing of illegally parked vehicles or legally parked vehicles with 5 or more outstanding parking citations, and to hold booted or towed vehicles for payment of outstanding parking citations.


BODY:
Whereas, Under current state law, the City of Milwaukee is authorized to tow only those vehicles which are illegally parked or abandoned on the street; a legally parked vehicle with outstanding parking citations may not be towed; and

Whereas, Current state law allows booting of vehicles which have been parked without authorization on private property, but does not allow the City to boot vehicles under any circumstances; and

Whereas, State legislation is pending which would allow the City to boot legally parked vehicles with outstanding parking citations and to hold them until the citations are paid or adjudication arrangements are made; and

Whereas, A federal court order resulting from a 1980 class action lawsuit on towing procedures holds that vehicles may not be booted or towed if they are legally parked, and requires the City to release vehicles towed as illegally parked upon payment of towing and storage charges, regardless of outstanding parking citations; and

Whereas, The Milwaukee Police Department currently tows vehicles parked in towaway zones or vehicles otherwise illegally parked with 2 or more outstanding citations more than 30 days old; and
