Title
Substitute resolution approving an exception to City requirement that sidewalks be developed in conjunction with the improvement of streets.
Analysis
Section 113-12.5 of the Milwaukee Code of Ordinances requires that sidewalks be installed on both sides of any street in the city in conjunction with the improvement of the street. This section also provides that the Common Council may waive or defer this requirement. This resolution waives the sidewalk-installation requirement for the area of W. Good Hope Rd. from N. 91st St. to N. 107th St. as part of the W. Good Hope Rd. Rehabilitation.
Body
Whereas, It is proposed that W. Good Hope Rd. from N. 76th St. to N. 107th St. be improved; and
Whereas, This improvement, known as the W. Good Hope Rd. Rehabilitation, would include the construction of sidewalks along W. Good Hope Rd.; and
Whereas, Section 113-12.5 of the Milwaukee Code of Ordinances requires that sidewalks be installed on any street constructed or improved in the city, and this section also provides that the Common Council may waive the sidewalk requirement on a case-by-case basis; and
Whereas, Installation of sidewalks in the proposed area would be inconsistent with the desires of the residents to have this area maintain its rural feel, as expressed in meetings regarding this topic, and with the character of new subdivisions in the immediate area that will not have sidewalks as well; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the sidewalk-installation requirement of s. 113-12.5 of the Code of Ordinances is waived with respect to the rehabilitation of both sides of W. Good Hope Rd. from N. 97st St. to N. 107th St., the north side of W. Good Hope Rd from N. 91st St. to N. 97th St., and the south side of W. Good Hope Rd. from N. 82nd St. to N. 91st St.
