Body
Whereas, The above-captioned case concerns a medical negligence action seeking compensation for the death of Susan M. Davis on April 14, 1996; and
Whereas, Plaintiffs are the husband and children of the late Susan Davis; and
Whereas, Plaintiffs settled with defendants for a total of $137,000.00, with disbursements made by attorneys totaling $41,663.50, and attorneys fees totaling $45,666.67; the balance remaining for distribution to the five members of the Davis family is therefore $49,669.83 with each individual plaintiff receiving $9,933.96; and
Whereas, The City is therefore not entitled to payment of its lien because the individual plaintiffs have not been made whole; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to authorize the waiver of the lien of $38,779.34, in settlement of this lawsuit.
