Resolution authorizing the First Amendment to and Third Extension of the Lease Agreement with South Harbor Milwaukee LLC
Analysis
This resolution would approve the first amendment to and third extension of the lease agreement with South Harbor Milwaukee LLC to allow construction, installation and operation of equipment systems to process Fats, Oils and Greases at the property located at 1726 South Harbor Drive and extend the expiration date to December 31, 2030.

Whereas, South Harbor Milwaukee LLC (“Tenant”) operating on 4.6 acres at 1726 Harbor Drive on the South Harbor Tract of Port Milwaukee (“Property”) has requested an amendment to and third extension of the lease agreement dated January 6, 2011; and
Whereas, On November 23, 2010, the Common Council adopted File Number 100781 authorizing the Board of Harbor Commissioners of the City of Milwaukee to enter into a lease agreement with South Harbor Milwaukee LLC.; and
Whereas, Tenant is working to establish and attract new business and is allowed to construct, install and operate equipment systems to process Fats, Oils and Greases at the Property with appropriate notification to Port Milwaukee staff; and
Whereas, Tenant by written notice dated July 10, 2025 has notified the Board of Harbor Commissioners of its intention, pursuant to Section 1 of the lease agreement, to extend the lease agreement for the third extension term commencing on January 1, 2026 and terminating on December 31, 2030; and
Whereas, This amendment includes an adjustment to the base rental provisions and adds an additional tonnage assessment and minimum annual tonnage guarantee; and
Whereas the Board of Harbor Commissioners of the City of Milwaukee approved the amendment and third extension of the agreement at its meeting on October 16, 2025; now, therefore, be it
