This resolution removes a deed restriction from said lot to allow for sale of part of it to the adjoining owner.
BODY:
Whereas, The Redevelopment Authority of the City of Milwaukee conveyed a vacant lot located at 2505-07 West Juneau Avenue via a Quit Claim Deed dated May 16, 1985, pursuant to Common Council File No. 82-113-2g, adopted April 19, 1985; and
 
Whereas, Said deed of conveyance contained a restriction that the land conveyed therein "shall be joined with the buyer's adjoining property so as to create a single parcel to be used as a unit and that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee"; and
 
Whereas, The current owners are entertaining an Offer to Purchase one-half of said lot from the adjoining owners, with their property located at 2509-11 West Juneau Avenue, for use as green space; and
 
Whereas, Removal of the deed restriction will allow the conveyance of one-half of said lot to the adjoining owners who have agreed to join this portion of said vacant lot with their property which will be reflected in the deed of conveyance; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restriction contained in the deed dated May 16, 1985, to allow for sale of one-half of said lot to the adjoining owners.
