Substitute resolution authorizing and directing the proper city officers to execute an Out-of-Program Agreement between August Urbanek and the City of Milwaukee for construction of public improvements to support Phase 1 of the Metro Center Development located generally south of West Good Hope Road and east of US Highway 41.

This resolution approves an Out-of-Program Agreement between August Urbanek and the City of Milwaukee for public infrastructure related to the proposed Metro Center Development.

BODY:
Whereas, August Urbanek has plans to construct a mixed use business park, the first phase of which will consist of an AutoNation car dealership; and
Whereas, This development will require various public improvements including sewer and water extensions, as well as a new public street; and
Whereas, The Common Council has previously approved acceptance of developer funds for preliminary engineering; and
Whereas, August Urbanek now desires to enter into an Out-of-Program Agreement with the City of Milwaukee to provide for construction of the required public improvements; and
Whereas, The Out-of-Program Agreement for this project is attached to this file, now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Out-of-Program Agreement attached to the file is hereby approved and the proper City Officials are hereby authorized and directed to execute said agreement on behalf of the City; and be it
Further Resolved, That the Commissioner of Public Works is authorized to make minor, non- substantive changes to the Out-of-Program Agreement prior to its execution.
