Title

A charter ordinance relating to settlement of claims against the city.
Sections
4-32 am
Analysis
Section 4-32 of the city charter, enacted in 1907, relates to the settlement of claims against the city, and in part requires members of the appropriate common council committee recommending settlement of a claim to sign the council file and have that action entered into the proceedings of the common council. This charter ordinance repeals that provision.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. The city of Milwaukee elects not to be governed by the provisions of ch. 493, Laws of Wisconsin, 1907.

Part 2. Section 4-32 of the city charter is amended to read:

4-32. Claims. Whenever a claim against [a] >>the<< city [[of the first class]] shall be settled by the common council, the reason for such action must be stated in writing [[and signed by the committee and entered upon the minutes of the proceedings of the common council]]. Whenever such settlement is made upon the recommendation of the city attorney or his assistant, or other legal officer, the reason therefor must be stated in writing, signed and filed with the city clerk, and published with the proceedings of the common council.

Part 3. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
