This resolution grants a special privilege to Charline Pittman to keep and maintain a concrete retaining wall encroaching into the public way on the south side of West Melvina Street, at the premises known as 3881 North 25th Street.
BODY:
Whereas, Charline Pittman is the owner of the premises at 3881 North 25th Street; and
Whereas, A 6 inches thick retaining wall was constructed that encroaches approximately 2 feet into the public right-of-way; and
Whereas, The retaining wall abuts the sidewalk, and therefore, does not comply with the requirements of Sec.245-4.6, Retainment Devices in the Public Right-of-Way Abutting Residential Property; and
Whereas, The retaining wall as constructed may only be permitted to encroach into the public right-of-way by the granting of a special privilege by the Common Council; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that Charline Pittman, 3881 North 25th Street, Milwaukee, WI 53206, is hereby granted the following special privilege:
To keep and maintain a concrete retaining wall within the public right-of-way on the south side of West Melvina Street, located at 3881 North 25th Street. Said concrete retaining wall commences at a point approximately 10 feet west of the westline of North 25th Street and extends west for a distance of approximately 65 feet. The 6 inches thick retaining wall encroaches into the 15 foot wide public sidewalk area approximately 2 feet. The wall height is approximately 2.5 feet and 3 feet above grade, at its east and west ends, respectively.
