Title
An ordinance relating to zoning regulations for freestanding signs.

Analysis
This ordinance provides that, notwithstanding any other regulations of the zoning code, a legal nonconforming freestanding sign which is not an abandoned sign and which is located on a lot abutting an arterial street may be replaced with a new nonconforming freestanding sign if the following conditions are met:

1. There is a reduction in the total number of freestanding signs on the lot.

2. The total display area of all freestanding signs does not exceed 2.5 times the amount permitted in the regulations for the applicable zoning district.

3. The height of the new sign exceeds neither the height of the sign it is replacing nor 2 times the sign height limit for the applicable zoning district.

If any one, but only one, of these conditions will not be met, the person desiring permission to replace the nonconforming sign may apply to the board for a special use permit to allow a new nonconforming sign.

Whereas, The Milwaukee Common Council finds that it is desirable and beneficial to provide incentives to businesses and property owners to reduce the number and size of nonconforming freestanding signs along arterial streets, even if the replacement signs are still nonconforming, albeit to a lesser degree; now, therefore

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 295-407-2-c of the code is created to read:

295-407. Signs.

2. ON-PREMISE SIGNS.

c. Incentive to Reduce Nonconformity; Freestanding Signs. c-1. General Standards. Notwithstanding any other provisions of this chapter, on a lot abutting an arterial street, a legal nonconforming freestanding sign which is not an abandoned sign may be replaced with a new nonconforming freestanding sign if all of the following are true:
