This resolution will remove a deed restriction imposed by the City of Milwaukee that prohibits construction of any principal buildings on the property.
BODY:
Whereas, Pursuant to Common Council File No. 912384, the City of Milwaukee conveyed to Leader Cards, Inc. by a Quit Claim Deed dated November 11, 1992, a tax-deed vacant lot at 907-11 South 5th Street that adjoined its property at 913 South 5th Street; and
 
Whereas, The deed of conveyance contained restrictions that the land conveyed therein "shall be used as open space and no principal buildings may be erected thereon," to join the lot with the buyer's adjoining property to create a single parcel and that the combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee; and
 
Whereas, Leader Cards, Inc. is in the process of business expansion and will be erecting a new structure on the combined parcel; and
 
Whereas, Removal of the deed restriction is required for the property owner to develop the proposed business expansion; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restrictions contained in the deed dated November 11, 1992, to allow for development of the property.
