Substitute resolution authorizing settlement in the case of Estate of Alice Kocinski v. The Home Insurance Company, et al., Case No. 598-098.
ANLS:
This resolution authorizes settlement of th lawsuit of the Estate of Alice Kocinski in the amount of $350,000.00, with payment of $260,750.00 by the City of Milwaukee.
BODY:
Whereas, The plaintiff, the Estate of Alice Kocinski has filed a lawsuit against the City of Milwaukee seeking an undetermined amount of damages; and
Whereas, The plaintiff has agreed to settle this lawsuit in the total amount of $350,000.00, including a payment by the City of Milwaukee of $260,750.00; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $260,750.00, payable to the order of the Estate of Alice H. Kocinski, and Phillips, Donohue & Cymerman, S.C., in full and final settlement of this lawsuit, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 01-149-0-6382-013-8001.
