Previous entity that had Judy's Red Hots (not Avanix, LLC) was closed due to a health inspection. The legal entity that has the ownership interest in the property where Judy's Red Hots is located is Avanix, LLC. Najmee Glass Works, LLC does not have a lease at the location. A lease must be submitted to the Licenses Committee that proves that the legal entity, Najmee Glass Works, LLC, has a lease. Otherwise the application is not valid. Ald. Puente moves to hold to the call of the chair. Prevailed 4-0. (Ald. Hines, Jr. excused.) Ald. Bauman wants the police report entered into the record. But since the application is not valid, Ald. Bohl says that it should not be entered. Mr. Dean says an oral lease is valid. The previous restaurants that the family owned closed, but not for any health violations or problems, but for lease issues. Because it is not a valid application, neighborhood testimony cannot be heard either.	Pass	4:0

Whereas, The Health Department received an objection from Ald. Robert Bauman for a food dealer license for Sara Khan at 2635 W. Kilbourn Avenue in the 4^th aldermanic district; and

The Common Council's Licenses Committee held an evidentiary hearing on the application on November 24, 2008; and

The Committee had objecting neighbors attend the hearing and heard police testimony; now, therefore,

It is moved, by the Common Council of the City of Milwaukee, that the food dealer license application of Sara Khan, Agent for Najmee Glass Works, LLC, for the premises at 2635 W. Kilbourn Avenue, ("Judy’s Red Hots") be denied.
