Atty. Maistelman said that the item on the police report is from her shareholder about an incident that happened at a Pick’n Save Store.
Individuals also present:
Ald. Spiker said that he met with the applicant at the location, which it is currently an Indian-Pakistani grocery store. He added that this store immediate adjacent to a condominium area and that he is concerned about selling full liquor at this location. He also said that the applicant owns a corner store on Vienna St but that this would be a step up operation. He added that he is comfortable with beer and wine and to work on building trust with the neighbors.
Atty. Maistelman said that the is not going to be only a liquor store, that there will be a food sit down area and to take out as well.
The applicant explained that there is a little kitchen in the back that she will use for processing food.
Ald. Zamarripa said that even the name calls for a liquor store rather than a food store and that he agrees with Ald. Spiker’s concern.
Ald. Burgelis pointed out that the food application says that it is for retail only.
There were no neighbors present to testify.
Ald. Spiker said that alcohol is another subject, that the parking lot is immediately adjacent to the condominium, and that it would affect the residents directly.
The applicant said that she understands Ald. Spiker’s concerns and that she asks for a chance to run the business.
Ald. Zamarripa asked the applicant if she is willing to get started with beer and wine only.
Atty. Maistelman said that is not feasible.
Ald. Westmoreland moved denial based upon the preponderance of the evidence on the applicant and aldermanic testimony that demonstrates the operation would result in a threat to health, safety and welfare of the public. (Prevailed 4-1)

He added that his client has given access to MPD to the surveillance system now and that they are working with MPD on safety issues. He added that 6 of the items on the police report are about the same individual who was given a TRO since he was loitering at the building at any time. He also said that the staff called MPD for all the disturbances except for one and that his client continue working on addressing the persisting issues.

Ald. Pratt said that there is a reduction on the items on the police report comparing to last year and that she is still concerned about the employees not cooperating with MPD. She asked what is the plan and if those employees are still working there.

Ald. Zamarripa asked the applicant if he has tried to file a TRO for those individuals who loiter at his establishment.
Sgt. Velasquez said that regarding Ald. Perez’s concern, the police would file a report if the call is made against the business.
Ald. Perez said that he has had issues with this location before was part of his district and that this location has a loitering problem that he would like to address with the applicant. He requested to hold this application.
Ald. Zamarripa said that she would like that the applicant requests a CPTED as well.

She added that the they cannot link these issues directly to this business but that they want to see some changes in the operation like not selling single serving beers to people that are struggling with addictions.
Ald. Zamarripa asked if she had a chance to meet with the applicant.
Ms. Brisa said that she has and that it was a positive meeting and looking forward to get better results.
Mr. Sponcia – 3509 W National Av - said that he supports the business and the applicants, that they take care of the property and pick up litter but that he is not in support of the alcohol license. He added that he understands that this would affect the sales but that there must be a compromise with the single serving beer cans to limit the nuisance activity on the block.
Individuals also present:
Ald. Zamarripa said that VIA and Mr. Sponcia both have invested in the Silver City neighborhood and while they are not in opposition of the business, they need support from the applicant with calling MPD when there is people loitering around. She added that she appreciates the willingness of meeting with MPD and her office and conducting a CPTED and that she wants to know if they are willing to amend the application.
Mr. Singh said that they will take the initiative in reporting panhandlers and people carrying open liquor and that they have taken out the 16oz cans.
Ald. Zamarripa said that the conversation was about eliminating the 16oz or greater with exception of Chelada o Michelada.
The applicant said that he is not willing to amend the application.
Ald. Zamarripa said that she would like to hold the application to clarify the misunderstanding.

Mr. Huennekens - 3952 S 51st St – said that the noise is his biggest concern with having a new bar in the area and that he would like to know what kind of performing dancers the applicant will have.
Ald. Pratt asked the applicant if she has a plan for when people leave the premises.
The applicant said that she has reached out to some neighbors directly to share her contact information. She also said that she is thinking to start with closing at midnight to see how it goes from there. She explained that she has 35 surveillance cameras and that MPD has access to them, that there will be security guards on weekends because they do not want people hanging out at the alley.

The applicant said that he is willing to provide remote access to MPD because he does not think that his staff must have access to the surveillance system.
Ald. Bauman said that the longer version said that the shooting did not happen in the parking lot and that the staff was uncooperative and that MPD was told that they were not going to provide the surveillance video. He added that this location is relatively close where a police officer got shot last week (high crime area) and that it seems that the employees are very anti police apparently.
The applicant said that the employees got reprimanded and retrained on the policies in place as employees.
Ald. Bauman said that he has no objections.
Ald. Zamarripa asked the applicant if he is willing to amend the application to conduct a CPTED.
The applicant agreed.
