Whereas, Plaintiffs, Kristin S. Noack and Barbara R. Smith, have filed a state law negligence claim against the City of Milwaukee.
Whereas, Counsel for the parties have reached an agreement to settle the above-referenced lawsuit for a total amount $125,000.00 subject to approval by the Common Council; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deem it expeditious and just to settle this lawsuit; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee, that the proper City officers be and hereby authorized and directed to issue a City check in the amount of $125,000.00 payable to the order of Gingras, Thomsen & Wachs, LLP Client Trust Account at 219 North Milwaukee Street, Suite 520, Milwaukee, WI 53202 as soon as practicable, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and be it
Further Resolved, that for and in consideration of the above-referenced payments, the plaintiff, by their representatives, and their attorneys, will provide to the City a release of any and all claims arising out of or in any way related to this incident.
