This resolution authorizes cancellation of Fire Department Invoice No. 45241 in the amount of $20,299.00, billed to Michael A. Runnoe and Luke A. Runnoe for damage to a 1991 Chevrolet van that occurred in an accident on July 1, 1996.
BODY:
Whereas, On July 1, 1996, a motor vehicle driven by Luke A. Runnoe was proceeding westbound on East Michigan Street, attempting to make a left turn southbound onto North Jefferson Street, when it collided with a motor vehicle operated by Gerald M. Washington and belonging to the Milwaukee Fire Department, which was proceeding eastbound on East Michigan Street, causing the Fire Department vehicle to collide with two parked vehicles; and
Whereas, A jury rendered a verdict after a trial in Milwaukee County Circuit Court, Milwaukee Guardian Insurance v. Gerald M. Washington and City of Milwaukee, Case No. 96-CV-009409, City Attorney No. 96-C-525, determining the City of Milwaukee was not liable for damages to any of the vehicles involved in the accident, and that the City of Milwaukee could not recover its property damages as stated in Invoice No. 45241; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that Fire Department Invoice No. 45241 in the amount of $20,299.00, billed to Michael A. Runnoe and Luke A. Runnoe, be and the same is hereby cancelled.
