Analysis

Currently, the building code requires every window required for ventilation - typically, one window per habitable room -- to have a screen covering at least 1/3 of the window area.  Screens are not required for windows above the 5th floor.

 

This ordinance provides that, in any rental dwelling unit, every openable window shall have a window screen covering at least 1/3 of the window area, with no exception for windows above the 5th floor.  With 2 exceptions, the property owner, not the tenant, shall be responsible for the installation and maintenance of window screens

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 275-42-4-b and c of the code is renumbered 275-42-4-c and d.

 

Part 2.  Section 275-42-4-b of the code is created to read:

 

275-42.  Ventilation. 

 

4.  WINDOW SCREENS. 

 

b.  Notwithstanding any provision of par. a, in any rental dwelling unit, every openable window shall have a window screen with a wire mesh of not less than number 16 covering at least 1/3 of the window area.  Except as provided in par. d, the property owner shall be responsible for the installation and maintenance of window screens.
