Analysis

This charter ordinance clarifies the contracting procedures for department of public works contracts.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 7-19 of the charter is repealed and recreated to read:

7-19.  Approval of Contracts and Bonds.

1.  PURPOSE.  This section is enacted to provide procedures for the execution of contracts by the department of public works.

2.  EXECUTION.  All contracts entered into, and all public notices required by law to be given by the commissioner of public works shall be countersigned by the comptroller, in the manner proscribed by the comptroller, and shall have no force unless so countersigned. All contracts entered into by the said commissioner, and all bonds taken by him or her, shall be entered into in the name of, and shall be executed to the city of Milwaukee. The term "contracts" includes agreements, and amendments and changes to contracts.

Part 2. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
