WHEREAS, Common Council File 241341 establishes a pedestrian mall known as “Nativity Jesuit Pedestrian Mall” in South 29^th Street from West Orchard Street to a point approximately 180 feet south of West Orchard Street; and

WHEREAS, Nativity Jesuit Academy desires to create recreational space in the pedestrian mall adjacent to their property at 1515 South 29^th Street; and

WHEREAS, a proposed soccer field, fencing, and other amenities desired by Nativity Jesuit in the pedestrian mall are not typical items in the right-of-way that DPW would maintain; and

WHEREAS, Nativity Jesuit is willing to assume maintenance responsibilities of the amenities that they desire in the pedestrian mall; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized and directed to execute a License Agreement between the City of Milwaukee’s Department of Public Works and Nativity Jesuit Academy, in substantially the same form as attached to this file, relating to the assignment of maintenance responsibilities at the Nativity Jesuit Pedestrian Mall; and, be it

Further Resolved, That minor changes to the License Agreement which do not change its intent are hereby approved.
