Analysis
This ordinance assigns the owner, occupant, or person in charge of the real property abutting or fronting the tree border the responsibility for keeping the area free of litter. Violators are given notice to correct the violation within 3 days. Failure to correct the violation within 3 days results in the same enforcement provisions that apply to keeping sidewalks free of snow, ice, mud, and dirt.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 116-8-0 of the code is amended to read:
116-8. Sidewalks >>and Tree Borders<< to be Kept Clean.
Part 2. Section 116-8-4 is renumbered to 116-8-5.
Part 3. Section 116-8-4 is created to read:
4. TREE BORDERS. It shall be the duty of the owner, occupant or person in charge of real property abutting or fronting a tree border to keep the tree border free of litter. For this subsection, “tree border” means the portion of the street right-of-way between the curb and the outside line of the sidewalk closest to the curb. The provisions of sub. 2 apply in determining the person responsible for compliance with this subsection. Upon determining that a tree border is not free of litter, the commissioner of public works shall provide notice of the violation and allow 3 days to correct the violation.
