- Analysis -

This ordinance provides that the holder of an alcohol
beverage license may offer entertainment consisting
solely of the presentation of plays on the premises
to which the license applies without obtaining a
tavern amusement license.

BODY:
The Mayor and Common Council of the City of Milwaukee
do ordain as follows:

Part 1. Section 90-33-1 to 5 is renumbered 90-33-2
to 6.

Part 2. Section 90-33-1 of the code is created to
read:

90-33. Kinds of Tavern Amusement, Dancing and Music
Licenses. 1. DEFINITION. In this section and s.
90-34, "plays" shall be defined as stage
representations of actions or stories. The conduct,
performances and costumes prohibited by s. 90-22
shall be prohibited in such representations.

Part 3. Section 90-33-2-a of the code is amended to
read:

2. TAVERN AMUSEMENT LICENSE. a. A tavern amusement
license shall entitle the holder to give, permit,
produce, present, conduct and offer entertainment or
exhibitions consisting of music, dancing, singing,
floor shows and cabaret performances upon the tavern
premises. >>Such a license shall not be required
whenever the holder of an alcohol beverage license
offers entertainment which consists solely of the
presentation of plays.<<

Part 4. Section 90-34 of the code is repealed and
recreated to read:

90-34. Licenses Required. No person licensed to
sell alcohol beverages shall offer or permit, on the
premises for which such license is granted, any
prerecorded or instrumental music, public or private
dancing, or exhibitions or entertainment of any kind
commonly classified under the term "cabaret," "night
club," "floor show" or "performance" without ha...
