WHEREAS, Travaux Inc. (Travaux) approved a contract with Champion Modular Inc. dba Champion Commercial Structures (Champion) (Troy, MI) for factory-built housing units for Westlawn Renaissance IV (Building 3.2 and 3.3) at Westlawn Gardens Phase 2, in an amount not to exceed $6,500,000.00, per Resolution No. T162 adopted on July 9, 2020; and

 

WHEREAS, Westlawn Renaissance IV LLC (WRIV LLC) and Travaux did not agree upon a Guaranteed Maximum Price pursuant to WRIV LLC’s award of a Construction Manager at Risk (as Constructor) contract to Travaux, and WRIV LLC consequently rescinded said contract; and

 

WHEREAS, Travaux no longer has any authority to engage construction subcontractors for Westlawn Renaissance IV (Building 3.2 and 3.3); now, therefore, be it

 

RESOLVED, by Travaux that it approves rescinding approval of a contract to Champion for factory-built housing units for Westlawn Renaissance IV (Building 3.2 and 3.3) at Westlawn Gardens Phase 2, in an amount not to exceed $6,500,000.00; and be it

 

FURTHER RESOLVED, that the proper officers of Travaux are hereby authorized and directed to properly rescind said contract for and on behalf of Travaux; and, be it

 

FURTHER RESOLVED, that all acts previously performed, relative to this matter, by the Board of Directors and the President be and hereby are approved, ratified, and confirmed in all respects.
