This resolution appropriates $145,769.66 from the 1993 Common Council Contingent Fund to pay sub-contractors that performed construction work on the Port of Milwaukee building. The City has withheld payment to the prime contractor, Marino Construction, because it has determined that the work was substandard.
BODY:
Whereas, The City of Milwaukee has withheld payment to Marino Construction, the prime contractor, for construction work performed at the Port of Milwaukee's new office building because the City has determined that the work was substandard; and
Whereas, This matter is currently under litigation and may take some time before it is resolved; and
Whereas, The City had to bring in another contractor to correct the original contractor's unacceptable work; and
Whereas, Sub-contractors hired by the original prime contractor have not been paid; and
Whereas, The nonpayment of sub-contractors has a detrimental effect on the financial viability of these small businesses and may pose severe hardship to them; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that $145,765.66 is appropriated from the 1993 Common Council Contingent Fund (Account No. 09 910-8000) and transferred to the Harbor Commission's Port Administration Building Account (Account No. 48-842-0453) to pay sub-contractors that performed work on the Port of Milwaukee's new office building as follows:
