This resolution extends the time for construction of a building on this property to June 1, 1999.
BODY:
Whereas, The City of Milwaukee sold certain Land Bank property now commonly known as 10501 West Brown Deer Road to K&H Development Corporation; and
Whereas, Said property was conveyed by Warranty Deed dated October 12, 1995, and recorded on November 1, 1995, in Reel 3662, Image 48, as Document No. 7144465; and
Whereas, The deed of conveyance provided for the construction of a facility on the property not later than 18 months following the date of sale; and
Whereas, K&H Development Corporation and the City of Milwaukee desire to modify this restriction as set forth in the Amendment Agreement; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the Amendment Agreement, substantially in the form attached to this Common Council File, is approved; and, be it
Further Resolved, That the proper City officials are authorized and directed to execute the Amendment Agreement on behalf of the City of Milwaukee; and, be it
Further Resolved, That the City Attorney is authorized to make ministerial changes in the Amendment Agreement as may be required to meet the intent of this resolution.
