Body
Whereas, Plaintiff David Fuerte incurred over $24,000.00 in medical bills when he broke his ankle on January 23, 1998 at 2100 West Wells Street; and
Whereas, This property was owned by Campus Neighborhood Associates and leased by the City of Milwaukee, with the City being responsible for clearing ice and snow; and
Whereas; The claimed damages sustained by plaintiff exceed $32,000.00; and
Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it expeditious and just to settle this lawsuit; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officers be and are hereby authorized and directed to issue a City check in the amount of $15,000.00, payable to the Trust Fund of Fuchs, Snow & DeStefanis, S.C., and David M. Fuerte, in full and final settlement of this lawsuit, upon receipt of a release of claims, approved as to form and execution by the City Attorney, said amount to be charged to the Damages and Claims Fund, Account No. 0001-1490-636506-2631-S118-2001.
