Title
Substitute resolution permitting a minor modification to the Detailed Planned Development (DPD) known as Humboldt Ridge, located on the North Side of East Garfield Avenue and West of North Humboldt Avenue, in the 6th Aldermanic District.
Analysis
This substitute resolution will allow for the construction of retaining walls for the two previously approved duplexes that was not part of the approved detailed plan.
Body
Whereas, Section 295-814(5) of the Milwaukee Code of Ordinances permits modifications to planned developments after approval of the Common Council; and
 
Whereas, The detailed plan for a planned development known as Humboldt Ridge was approved by the Common Council of the City of Milwaukee on December 15, 2000, under File No. 000550; and
 
Whereas, The owner is requesting to modify the previously approved plans to allow for the construction of retaining walls along East Garfield Street for the two previously approved duplexes; and
 
Whereas, The proposed retaining walls are consistent with the spirit and intent of the approved detailed plan, will not adversely affect surrounding development and a copy of which is attached to this Common Council File as Exhibit A which is on file in the office of the City Clerk and made a part as though fully set forth herein; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the minor modification to allow for the construction of retaining walls for the two duplexes that was not previously approved as part of the Detailed Planned Development is approved.
