Analysis
This resolution authorizes settlement of claims raised by the Plaintiff, Torrey D. Hardy, in the Complaint entitled Torrey D. Hardy v. Alondra Santiago, Oscar Espita, Nicholas Romeo, Jordan Bryant, City of Milwaukee, et al. EDW Case No. 24-CV-1107 in the amount of $90,000.00.

Whereas, Plaintiff Torrey D. Hardy filed a complaint with the Eastern District of Wisconsin, Case No. 24-CV-1107, against the City of Milwaukee, and Milwaukee Police Officers Alondra Santiago, Oscar Espita, Nicholas Romeo, and Jordan Bryant, seeking damages for alleged violations of the Fourteenth Amendment through 42 U.S.C. § 1983, and various state law claims; and

Whereas, the parties have agreed to settle the claims raised in the above-referenced Complaint for the total amount of $90,000.00 inclusive of all taxes, costs and fees, including attorney’s fees; and

Whereas, The City Attorney recommends and deems it expeditious and just to settle this lawsuit; now, therefore, be it

Resolved, by the Common Council of the City of Milwaukee, that the proper City officers be and hereby are authorized and directed to issue a City check in the amount of $90,000.00, payable to: Torrey D. Hardy and mailed to his attorney, Todd R. Korb, Hupy & Abraham, S.C., 111 East Kilbourn Avenue, Suite 1100, Milwaukee, WI 53202, as soon as practicable; and so be it

Further Resolved, that in compliance with the City Attorney’s direction, the proper City officers be and hereby are authorized and directed to issue a check, as soon as practicable, in full and final settlement of all claims as outlined in the above-referenced action, to be charged to the Damages and Claims Fund, Account No. 0001-1490-S118-006300; and so be...
