Fortney based upon the preponderance of the evidence in the police report that demonstrates the operation results in a threat to health, safety or welfare of the public for the assaults, battery and disturbance of the peace; for the premises located at 1209-13 N Water St. (“Brothers Bar & Grill”) in the 4th aldermanic district. (Written objections have been filed) Nonrenewal of the Disabled Loading Zone for Carolina Navejar located at 3055 S 14th St. based upon second nonappearance. This loading zone is located in the 14th aldermanic district. (No written objections have been filed) All member indicated they had read the Report and Recommendations of the Licenses Committee. Ald. Mr. Singh (stockholder) said that there a is a sort of miscommunication because there was an adult that he believes was the aunt of the kid who ordered the gummies (with Delta-8) that are behind the counter with a glass in between. He added that he talked to the police and that he was told that if they believe that the intention is to give that kind of products to a child, then they should not hand the product out. Chambers said that the situation is very freighting, that he spoke to the applicant, that he has learned a lesson and has implemented a plan moving forward. Ald. Chambers moved approval with a warning letter based upon the preponderance of the evidence on the police report. Ald. Burgelis asked the applicant if he disputes the police report that describes the footage of the surveillance where the clerk hands out the pack of gummies to the child. The applicant said that he did not watch the video. Ald. Chambers asked Sgt. Velasquez is there is a citation for this matter. Sgt. Velasquez said that they have no jurisdiction to do it. Ald. Zamarripa asked the public to contact their legislators about this concerning situation. Ald. Ovbiagele. Individuals in objection: Atty. William Sulton – 2745 N MLK Dr #202 – said that he is talking on behalf of the next door building owner who is in objection and is his client. He added that he is here to talk about 530 N Water St which is a nuisance property. Atty. Ovbiagele objected on the basis of hearsay. Ald. Zamarripa said that Atty. Ovbiagele’s objection is noted. Atty. Sulton said that is not a hearsay, that a lawsuit was accepted by the clerk of court this morning against SOCHE LLC and Corey Smith and the nuisance property that is causing damages to his client. Atty. Ovbiagele objected to hear about a lawsuit that they have not seen yet and that Atty. Sulton has no personal knowledge. Atty. Sulton said that he is here to talk on behalf of his client and not as a witness. Atty. Gresham said that the applicant’s attorney can speak on the legal matters just to feel the narrative. Motiya Q. Lopez – 532 N Water St – Adjacent building owner - said that she formally objects to the renewal of the license for City Social Bar and Grill. She also said that she has owned this building for 20 years and worked very well with other business throughout the years but that it is proven how difficult is to work with this establishment. She added that they have filed a nuisance lawsuit because she has been requested to vacate and end many leases earlier with penalty because of the circumstances surrounding the operation of this establishment. She also said that the noise from bar & grill is more like a nightclub and that she believes that is something that was not initially disclosed when the applicant first applied for the license. She explained that the music is loud during the day until after 2am and that the establishment is not capable to manage the level of the intoxication of the patrons and they have to clean plastic cups, bottles and there is people urinating and vomiting by her property. She also mentioned that her parking spots on the back are taken by patrons of this establishment. Ald. Pratt asked the applicant if she has called MPD. Ms. Lopez said that she has called numerous times every month and that she is surprised that there is no record of her calls but that she has a log. Atty. Ovbiagele asked Ms. Lopez if she lives in the building and that if she has vacancies. Ms. Lopez answered “no” and that she has one vacancy. Atty. Ovbiagele asked how many tenants have asked to get out of their leases. Ms. Lopez said that two at this moment. Atty. Ovbiagele asked if the observations reported to the police are made by her. Ms. Lopez said that she is the general contractor and she is there numerous hours everyday and that some are reported by her tenants and some are her own observations. Mr. Herzon Lopez – said that he loves this city to this day but that this business is filthy, loud and obnoxious, that is not a good staple to the city and that it should not be what this committee and city stands for due the debris, vomiting and urinating. He added that he does not want to see to go to waste all the great efforts that have been made to get the attention that Milwaukee is getting lately. Atty. Ovbiagele asked Mr. Lopez if he has reached out to Mr. Smith to talk about all these issues. Mr. Lopez said that he has not but his wife has done it. Atty. Sulton said that he is talking about items that have been reproduced like photographs, videos and they are enough evidence to support the lawsuit that they just filed. He added that he has seen the garbage and loitering. Kathy Horton – 532 N Water St - asked not to renew this license, that it took her six months to find the right place and that since April 17th, her floors and walls are shaking and that she called her landlord the next day to be told that no complaints were received before. She said that she took it upon herself and wrote a letter to Mr. Smith and that he replied saying that it was her landlord’s responsibility. She called DNS, the License Division and MPD and she was told that she needed to prove her complaint so she took photos and videos of the applicant, his business and patrons even in front of her door. She added that there was no chance to know what was happening because that apartment was empty for 8-9 months due renovations and they did not have a chance to experience what she is experiencing now. Ald. Pratt asked Mrs. Horton if she decided to live there knowing that there was a bar next door. Mrs. Horton said that they did because she has some documentation that historical buildings cannot not be exposed to too much vibration. Ald. Bauman said that this witness shares a wall with the bar’s building. Tom Horton – 532 N Water St - said that they realized that there were moving to a busy spot and that there is a difference between loud and excessive noise and they only want to have a decent quality of life. He said that they cannot be on the back of their apartment due the excessiveness of noise and that things must be done to curve the problem. He added that patrons come in and out all the time yelling and that, he is shocked that no one has being hit yet. Officer Velasquez said that the calls about noise started to come on 4/25 and that the calls are so recent that they did not make it to this report. She added that reports were due on 4/30 and that it takes her about a week to approve reports sent to her. Ella Harris – 5834 W Elliot Cr – aunt of the building owners – said that her niece pick her up for dinner last fall, that they stopped at the property thru the alley and found the 3 parking spaces blocked. She added that they saw an older man urinating by next door’s garbage cans and that the man was very hostile with them when he was asked to move his truck. Individuals in support: Ms. McKenzie – 901 W Winnegabo St - said that City Social is the place where she comes with her children after church on Sundays, that she has worked for the applicant and her son works there, that the applicant is a good neighbor and that the issues on the street are not necessarily tied to this business. Mr. Thomas III - 11010 W Heritage Dr – said that he is a retired police officer and a community activist, that he is a patron and feels comfortable at City Social. He added that the applicant is professional, that he uses his professional experience to observe what is going on and that he would let the applicant know of any issues that might turn in a problem later. He added that the applicant has done a lot for the well being of the community and contributed to the economic development of the city. Mr. Baldwin – 524 N Water St – said that he is owner of the building adjacent south to this business and that everything what he heard from the objectors is an alternative reality because he lives in the 4th floor and has not heard the loud noise except for the garbage trucks when they pick it up. He added that the applicant has contributed to the economic and development growth of the area. He also said that he has not heard any excessive noise than the ones related to downtown. Mr. Smith – 1951 N MLK Dr – said that it is a beautiful and well run establishment and that he is grateful to have it here in the city. Ms. Willard – said that she works at City Social and that the police comes after they have closed the garage doors and turned the music down. She added that it does not make sense what one of the neighbor said because they hold all sort of events from book signs to people coming from funerals and that it is insulting to say that it is a place of danger. Mrs. Johnson – 524 N Water St – said that she lives next door, that the establishment is clean, that the noise is not excessive and that she has lived there since 2020. She added that the applicant is well known in the community. Individuals also present: Ald. Bauman said that he is glad that a lawsuit has been filed because he thinks is the proper channel to resolve the issues between the parts. He added that the noises described are proper to the downtown area, that he does not have a doubt about the neighbor’s objection hearing loud noises but that he thinks it is the nature of the old building and that there is no much that this committee can do about it. He added that he does not see grounds for nonrenewal because there is no police report, no calls for service and what we have here is un reconciled relation between this business and the objectors. Individuals in objection: Rose Terrell – 7702 W Burleigh – said that she has 9 years living there, that she has videos and pictures of the calls she made to the police about gun shots happening on October 14 at 7:43 pm and that 4 bullets cases were found. She also said that she has videos of the security guard moving costumers from the front of the business to the east of her department where they still drinking, cursing, smoking and loitering. She added that she cannot sit at her living room afraid of more fire shots and that she cleans up her plant pots every morning before she goes to work. Sgt. Velasquez said that there is a call for service that she does not know why is not attached to the police report. Robert Krierdermann – 7700 W Burleigh – building owner- said that he goes at night to check and that there is a lot of shaking because of the loud music and that he is concerned about the shootings. He added that he has put a lot of money in the building and that he is losing revenue because the issues with the bar. He added that he has not called the police but that he has all the pictures and videos from tenants and his own evidence from when he arrives later. Ald. Westmoreland asked if Mr. Kriedermann has had communication with the business owner. The witness said that he has not. Ald. Westmoreland said that there is a video submitted anonymously that was properly noticed and asked the committee to see it. Atty. Travis said that the if the video is anonymous, it is easy to object at the court. The applicant said that she objects to the video be played. Ald. Zamarripa asked the committee if they want to see it. Ald. Burgelis moved to watch the video. The motion prevailed 3-2. The video was played. Ald. Westmoreland said that the video is consistent with what it is reported to his office. The applicant said that regards the shootings happened on a Monday when they are not open and that shootings have happened in day broad light and that police has come to check the surveillance video. She added that they do not give bottles but plastic cups and that the video has taken on 79th St and that they are on 77th St but that they have been checking down the street after they were informed. She also said that for her is the same person complaining over and over again. Ald. Westmoreland said that the location has no parking lot and that patrons park all the way on 79th St. Ald. Westmoreland recognized that the applicant communicates with him. Ald. Westmoreland said that he is concerned about the shootings not been reflected on the police report. Sgt. Velasquez said that there were two calls for service for shots being fired, that one was linked to the Pizza Hut (10/14/24) and that the other one was about two vehicles fighting (10/19/24), so the shots are not associated to this premises. . Ruthie Johnson - 5240 N 45th – said that she is at the Salvation Army for long time and sees a lot of prostitution and drugs. She added that she stopped going to this business because it is too much going on, that people uses their garage for hotel and to use drugs. She added that she objects to the business practices of going to one place buy something at $2 to sell it for $4 there. She also said that she supports decent hours of operation. Mr. Singh said that the garage was an issue when he bought this business and that he has teared it down. Ms. Johnson that the people still hanging out there until 4am and that the extended hours would make it worse. Ms. Thompson - 5118 N 40th St – said that the area is dangerous with so many people hanging around and coming out from the bus. She added that she feels afraid because she lives alone and that she even sees people walking down the street with no shoes or clothes on and screaming. She said that she has to call the police a lot. Malcolm B. Williams - 5154 N 40th St – said that with all the bad things that they see in the neighborhood that come with that corner store, asked why a corner store would have to be open 24/7. Individuals also present: Ald. Pratt asked if the new applicant will be closing at 9pm as well. Mr. Singh said that they have worked to make this location a good business and that he is planning to install a kitchen and a sort of fresh market. He added that he would like to close at midnight because it adds value to his business, which he just got two years ago. Ald. Pratt said that she prefers an earlier closing time because she has been working a lot in the area on problems that happens at late hours. Ald. Chambers said that it seems that the residents would like to keep the closing hours at 9pm and that Ald. Pratt is saying the same thing.
