A substitute resolution relating to an appeal of the Historic Preservation Commission's denial of a certificate of appropriateness for the installation of a chain-link fence on the property at 3401 West Kilbourn Avenue.

- Analysis - This resolution reverses the Historic Preservation Commission's July 19, 1999 decision to deny a certificate of appropriateness for the installation of a chain-link fence on the property at 3401 West Kilbourn Avenue.
BODY:
Whereas, The property located at 3401 West Kilbourn Avenue is located in the City of Milwaukee-designated Concordia Historic District; and

Whereas, Section 308-81-9 of the Code of Ordinances prohibits the owner of a structure in a historic district from altering the exterior of such a structure without first obtaining a certificate of appropriateness from the City's Historic Preservation Commission; and

Whereas, On July 19, 1999, the Historic Preservation Commission denied a request for a certificate of appropriateness for a chain-link fence installed on the property at 3401 West Kilbourn Avenue; and

Whereas, Section 308-81-9-f of the Code provides that, whenever a request for a certificate of appropriateness is denied, the applicant may appeal the decision of the Historic Preservation Commission to the Common Council, which may reverse or modify the Commission's decision; and

Whereas, Nick Buttitta, the owner of the property at 3401 West Kilbourn Avenue, has filed a written appeal of the Historic Preservation Commission's denial of the certificate of appropriateness; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council reverses the July 19, 1999 decision of the Historic Preservation Commission denying a request for a certificate of appropriateness for the installation of a chain-link fence on the property at 3401 West Kilbourn Avenue.
