Title

Resolution rejecting a reservation for public street purposes at West Heather Avenue extended from North Lauer Street west to the ¼ section line, in the 9^th Aldermanic District.

Analysis

A new subdivision is proposed to be developed generally located south of West Brown Deer Road at North 116^th Street.  Given the new street pattern, an existing street reservation located on the east side of the proposed subdivision plat is no longer needed.  A new public street, however, is needed north of this reservation that will extend newly created West Brittany Way to the east connecting with North Lauer Street.  This resolution will eliminate from certain property an unnecessary reservation for street purposes.

Body

Whereas, A 70.00-foot wide reservation for public street purposes was created by Certified Survey Map Number 6654, recorded in the Milwaukee County Register of Deeds Office, on May 6, 1999, as Document Number 7738290; and

Whereas, The owner of the property has agreed to quit claim the north 60.00 feet of their property to the City of Milwaukee for public street purposes to better serve a proposed subdivision development to the west; and

Whereas, The City of Milwaukee no longer deems it necessary to retain the 70-foot wide reservation for public street purposes; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee hereby rejects the reservation for public street purposes, described as follows:

The southerly 70.00 feet of Parcel 2 of Certified Survey Map No. 6654, in the Northeast ¼ of Section 7, Township 8 North, Range 21 East; and, be it

Further Resolved, That the City Engineer is hereby directed to have a certified copy of this resolution recorded in the office of the Register of Deeds of Milwaukee County.
