This resolution removes a deed restriction from said lot to allow for its sale to the other adjoining property owner.
BODY:
Whereas, The City of Milwaukee conveyed to Robert Sewell, Jr. a vacant, tax deed lot located at 236 West Concordia Avenue adjoining his property at 228 West Concordia Avenue via a deed dated November 18, 1991 pursuant to Common Council File No. 901699; and
Whereas, Said deed of conveyance contained a restriction that the land conveyed therein "shall be joined with the Grantee's adjoining property so as to create a single parcel to be used as a unit; and that said combined parcel shall not be divided without the approval of the Common Council of the City of Milwaukee"; and
Whereas, Mr. Sewell is entertaining an Offer to Purchase said lot from the other adjoining owner, Mr. Ollie Love, with his property located at 3312 North 3rd Street; and
Whereas, Removal of the deed restriction will allow Mr. Sewell to convey said lot to Mr. Love who has agreed to join this lot with his property which will be reflected in the deed of conveyance; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee that the proper City officials are authorized and directed to execute the necessary legal documents to remove the restriction contained in the deed dated November 18, 1991, to allow for the sale of said lot to the other adjoining owner.
