Analysis
The property owner on the northeast corner of East Seeboth Street and South 1st Street requested the right-turn by-pass be vacated to square off their property to support the development on that block. Common Council Resolution File Number 030016 was adopted on May 25, 2004 which granted the partial street vacation. As part of the vacation, the property owner agreed to grant the City an easement to allow communications conduit and manhole to remain in place within the vacation limits. This resolution approves and authorizes the City to execute an agreement with the property owner to allow these City facilities to remain in place on private property. The easement grants the City permission to keep and maintain these facilities on private property.

Whereas, At the abutting owner's request, the northeast corner of East Seeboth Street and South 1st Street was vacated by Common Council File Number 030016 on May 25, 2004; and

Whereas, A condition of said vacation was that the property owner would grant an easement to the City to allow the existing communications conduit and manhole to remain in place and allow the City to maintain and operate said facility; and

Whereas, The terms of said easement are set out and attached to this file and approved as to content by the City Engineer and as to form by the Office of the City Attorney; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that said easement be and the same is hereby approved, and the proper City officers be and they her...
