Substitute resolution to settle claim of Lizzie Fenelon for property damage.

Whereas, Members of the Judiciary and Legislation Committee have reviewed the records relating to this claim in the amount of $536.00, relating to damage sustained to a fence and garage door on January 2, 2005 allegedly caused by the City of Milwaukee Fire Department in the alley behind 3732 North 10th Street.  Based on this review, members of the Committee, despite the recommendation of the City Attorney, recommend that the claimant be reimbursed  $125.00 in partial payment of this claim; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the proper city officers be and they hereby are authorized and directed to issue a city check in the total sum of  $125.00 payable to Lizzie Fenelon, 3732 N 10th Street, Milwaukee, WI  53206-3315, to reimburse her for the damage; and, be it
 
Further Resolved, That the check is to be delivered upon presentation of a proper release, approved by the City Attorney; said amount to be charged to Account No. 636505,  Fund - 0001, Organization - 1490, Program - 2631, Sub Class - S118.  This resolution would release the City from any further liability arising from this incident.
