Analysis

The resolution authorizes the proper City officials to execute sewer and water easements in vacated North Hopkins Street from approximately 150’ North of West Douglas Avenue to the Union Pacific (formerly Chicago & Northwestern) Railroad, in the 9^th aldermanic district.

Body

Whereas, the public right-of-way vacation was requested by Milwaukee County Parks for the expansion of their park facilities, and.

Whereas, The City asserts its rights under Wis. Stat. Sec. 66.1005(2) to continue to hold an easement and rights incidental in and to the easement areas within the vacated ROW, now, therefore, be it.

Resolved, by the Common Council of the City of Milwaukee, that the proper City officials, including the DPW Commissioner, are hereby authorized: (i) to sign Sewer and Water Easement in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
