Analysis
This ordinance requires the mayor to nominate members to the historic preservation commission within 90 days of a vacancy. Should the mayor not nominate a member within 90 days, the common council president will have 90 days to nominate a member, subject to common council confirmation.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 320-21-4 of the code is amended to read:
320-21. Historic Preservation Commission.
4. MEMBERS. a. Composition. The commission shall be composed of 7 members. One shall be a registered architect; one shall be either an historian or an architectural historian, either interested in the field of historic preservation; one shall be a person experienced in either real estate development or real estate financing; one shall be a member of the common council and 3 shall be citizen members. Each member shall have, to the highest extent practicable, known interest in preservation. Members shall be appointed by the mayor subject to confirmation by the common council. >>The mayor shall provide the common council with a nominee within 90 days of a vacancy due to resignation, death, removal or otherwise. If the mayor fails to make such nomination within 90 days, the common council president shall make a nomination within 90 days subject to confirmation by the common council.<<
b. Terms. Members shall be appointed for terms of 3 years. Members may be reappointed for succeeding terms. Any member may be removed for just cause by the mayor upon notice and public hearing. When any member is removed or resigns, or when a vacancy occurs, the mayor shall appoint a new member in the same manner as prescribed in par. a.
