Analysis
This ordinance clarifies recently passed legislation which imposes a penalty on a patron who enters or remains in an establishment holding a Class "B" license during prohibited hours.  This ordinance, in compliance with ch. 125, Wis. Stats.,  permits hotels, restaurants, bowling centers, indoor horseshoe-pitching facilities, curling clubs, golf courses and golf clubhouses which hold Class "B" licenses to have patrons in their establishments during prohibited hours, but may not sell intoxicating liquor during those hours.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 90-15-3-a-2 of the code is repealed and recreated to read:
 
90-15. Hours of Operation.
3.      CLASS "B" FERMENTED MALT BEVERAGE AND INTOXICATING LIQUOR
RETAILER LICENSES OR CLASS "B" SERVICE BAR LICENSE.
a-2.  Hotels and restaurants the principal business of which is the furnishing of food, drinks or lodging to patrons, bowling centers, indoor horseshoe-pitching facilities, curling clubs, golf courses and golf clubhouses may remain open for the conduct of their regular business but may not sell intoxicating liquor or fermented malt beverages during the prohibited hours under subd. 1.
