Title

Analysis
This resolution authorizes and directs the City Engineer, Commissioner of Public Works, and the Commissioner of the Department of City Development, as appropriate, to execute and implement the terms of a "Connecting Highway Change Agreement" and a "Park East Freeway Land Disposition Plan and Agreement" with the State of Wisconsin Department of Transportation and with Milwaukee County relative to the reconfiguration of the Park East Transportation Corridor from approximately North 8th Street to North Jefferson Street.
Body
Whereas, On April 26, 1999, Governor Tommy Thompson, County Executive F. Thomas Ament and Mayor John O. Norquist announced they had reached an agreement on how to expend the $241 million in Interstate Construction Estimate ("ICE") funds for transportation improvements in and around downtown Milwaukee ("ICE Agreement"); and
 
Whereas, The terms of said agreement were set forth in a document entitled "Letter of Agreement on the Allocation of ICE Dollars and on Milwaukee Transportation Projects" ("ICE AGREEMENT") and executed by Mayor John O. Norquist, Milwaukee County Executive F. Thomas Ament, and Governor Tommy Thompson; and
 
Whereas, The ICE AGREEMENT, in part, defined a project to reconfigure the Park East Freeway Transportation Corridor by ". . .reducing the length of the current facility, re-establishing a connection to I-43, constructing a new river crossing, and making other street modifications" and estimated the cost of the project to be $25 Million of which $8.0 Million is the State of Wisconsin portion ($6.8 Mil Federal; $1.2 Mil State match) and $17.0 Million is the City of Milwaukee portion ($14.45 Mil Federal; $2.55 Mil City Match); and
 
Whereas, The Common Council of the City of Milwaukee adopted Common Council Resolution File Number 990947 on November 19, 1999, authorizing and directing the Commissioner of Public Works to execute a document entitled "State/Municipal Agreement for a Highway Improvement Project - Park East Freeway, STH 145, North 6th Street to North Jefferson Street" ("Project Agreement") defining the project described in the ICE AGREEMENT noted above; and
 
Whereas, Said Project Agreement contains provisions for the execution of a Jurisdictional Transfer Agreement, to account for the redefinition of Lands within the Park East Corridor used for Public Rights of Way and Transportation purposes, a Land Disposition Plan in accord with Title 49, Code of Federal Regulations, Section 18.31, to account for the Park East Corridor Lands other than those used for Transportation Purposes, and, by virtue of the above jurisdictional changes, necessitates the execution of a Connecting Highway Change Agreement, to redefine the connecting highway system as altered by the Park East Corridor reconfiguration; and
 
Whereas, The Common Council of the City of Milwaukee adopted Common Council Resolution File Number 990416, on August 3, 2000, authorizing and directing the appropriate City Officials to execute the Jurisdictional Transfer Agreement; and
 
Whereas, The State of Wisconsin Department of Transportation, in cooperation with the City of Milwaukee and Milwaukee County, has now prepared the "Connecting Highway Change Agreement" and the "Park Freeway Land Disposition Plan and Agreement" for execution by the appropriate City and County Officials; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized and directed to execute the "Connecting Highway Change Agreement between the Wisconsin Department of Transportation and the City of Milwaukee" to redefine the routing of STH 145 in the City of Milwaukee as a result of the reconfiguration of the Park East transportation corridor, a copy of which is attached to this file by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works is hereby authorized and directed to execute the "Park East Freeway Land Disposition Plan and Agreement between the Wisconsin Department of Transportation and Milwaukee County and City of Milwaukee for Park East Freeway - STH 145 (North 8th to North Jefferson Street)", defining the conveyance of remnant lands created by the reconfiguration of the Park East transportation corridor to Milwaukee County or, under specific conditions, the City of Milwaukee, a copy of which is attached to this file by reference as though set forth in full; and, be it
 
Further Resolved, That the Commissioner of Public Works, the City Engineer, the Commissioner of the Department of City Development as well as other City Officials as may be appropriate, cooperate with the State of Wisconsin and Milwaukee County in implementing the terms of said agreements; and, be it
 
Further Resolved, That non-substantial changes to the Connecting Highway Change Agreement or the Park East Land Disposition Plan and Agreement may be made without further Common Council action.
