Title
Resolution amending the disposition of various surplus, tax-deed vacant lots in the 2900 block of North 20th Street to authorize sale to Bethesda Missionary Baptist Church for church construction, in the 7th Aldermanic District. (DCD)
Analysis
This resolution will result in the sale of seven surplus, tax-deed vacant lots for church construction.
Body
Whereas, Common Council File No. 020160 declared seven tax-deed vacant lots in the 2900 block of North 20th Street surplus to municipal needs and authorized the Department of City Development ("DCD") to accept an Offer to Purchase from Praise Temple Baptist Church for church construction; and

Whereas, Praise Temple Baptist Church purchased an existing facility and has canceled their Offer to Purchase; and

Whereas, Bethesda Missionary Baptist Church has submitted an unsolicited Offer to Purchase said lots, which are listed below, in the amount of $15,000 for construction of a church and associated parking:

; and

Whereas, Bethesda Missionary Baptist Church also has submitted a preliminary site plan and building elevation that is acceptable to DCD in addition to a financial commitment in the amount of $1 million; and

Whereas, The deed of conveyance for some of the lots may contain City-imposed deed restrictions preventing division of said lots and prohibiting construction without the prior approval of the Common Council of the City of Milwaukee; and

Whereas, In order for Bethesda Missionary Baptist Church to assemble the lots and build upon them, the City-imposed deed restrictions must be released; and

Whereas, This resolution will authorize the Commissioner of DCD or designee to prepare the necessary documents for restriction releases; and

Whereas, DCD recommends acceptance of said Offer with closing contingent upon approval of the final site plan and building elevation by its Development Center and submission of a firm financial commitment to complete the project as proposed; and

Whereas, Said lots are to be sold in an "as is" condition without representations or warranties including but not limited to soil quality and subsurface condition; and

Whereas, The City Plan Commission previously determined that said lots are surplus to municipal needs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of DCD and/or assigns is authorized to accept the unsolicited Offer to Purchase said surplus lots from Bethesda Missionary Baptist Church and to perform such acts as necessary to carry out the intent of this resolution and close the sale; and, be it
