Analysis

This resolution approves a Public Improvement Maintenance Agreement for Cherokee Point Subdivision between the City of Milwaukee and the board of the Cherokee Point Subdivision Association, Inc.  The agreement authorizes the board to install certain unique improvements within City right-of-way and also requires the board to assume the maintenance responsibility for those unique improvements.

Body

Whereas, The City of Milwaukee has previously approved a subdivision map for a residential development known as Cherokee Point; and

Whereas, The subdivision will include several unique improvements within the public right-of-way under the jurisdiction of the City of Milwaukee; and

Whereas, A homeowners' association known as the Cherokee Point Subdivision Association, Inc. has been established; and

Whereas, One of the functions of the homeowners' association is to carry out maintenance of common areas within the subdivision; and

Whereas, The association is willing to assume certain maintenance obligations for the unique improvements to be installed in the public right-of-way; and

Whereas, The homeowners' association maintenance responsibilities are outlined in an agreement entitled Public Improvement Maintenance Agreement for Cherokee Point Subdivision, a copy of which is attached to this file; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee that the Public Improvement Maintenance Agreement for Cherokee Point Subdivision is hereby approved and the appropriate City officials are hereby authorized to execute it on the City's behalf; and be it

Further Resolved, That the Commissioner of Public Works is authorized to make minor, non-substantive changes to the agreement prior to its execution.
