Title

Resolution authorizing the proper City officials to opt into new national opioid settlements relating to the National Prescription Opiate multidistrict litigation.

Analysis

This resolution authorizes the proper City officials to opt into additional opioid settlements for which the City is eligible for new settling defendants in the settlement of the National Prescription Opiate multidistrict litigation in the United States District Court for the Northern District of Ohio Eastern Division, case no. 20-op-45044-DAP.

Body

Whereas, On January 29, 2020, the City of Milwaukee joined the National Prescription Opiate multidistrict litigation; and

 

Whereas, On March 22, 2022, the Common Council adopted Resolution File Number 211799, relating to settlement funds received from opioid litigation, which resolved that settlement funds received in this litigation shall be used to fund the Milwaukee Overdose Response Initiative and other harm-reduction strategies; and

 

Whereas, On August 12, 2022, the Common Council adopted Resolution File Number 220562, authorizing the proper City officials to accept disbursements of settlement payments relating to the National Prescription Opiate multidistrict litigation; and

 

Whereas, On April 3, 2023, five additional proposed national settlements were added to the settling defendants, Teva and Allegan, and retailers, CVS, Walgreens, and Walmart;

 

Whereas, One additional proposed national settlement has been added to the settling defendants; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that, in relation to the City’s involvement in the National Prescription Opiate multidistrict litigation in the United States District Court for the Northern District of Ohio Eastern Division, case no. 20-op-45044-DAP, the proper City officials are authorized to opt into additional opioid settlements for which the City is eligible for new settling defendants; and, be it

 

Further Resolved, That no appropriation or expenditure of settlement funds received under this resolution shall be permitted unless authorized in a subsequent resolution.
