Title

Substitute resolution to vacate a portion of the West Side of North Water Street between East Knapp Street and East Ogden Avenue, in the 6th Aldermanic District.

Analysis

This substitute resolution vacates the above portion of street in accordance with vacation proceedings under power granted to the City of Milwaukee by Section 62.73, Wisconsin Statutes, and Section 308-28, Milwaukee Code of Ordinances. This vacation was requested by Milwaukee County Real Estate for re-alignment of streets for Block 12 as identified in the Park East Redevelopment Plan area for future sale and development.

Body

Whereas, It is proposed that a portion of the West Side of North Water Street between East Knapp Street and East Ogden Avenue be vacated pursuant to the provisions of Section 62.73, Wisconsin Statutes; and

 

Whereas, The Common Council of the City of Milwaukee approved the Park East Redevelopment Plan on June 15, 2004, which identified the preparation of a final subdivision plat to dedicate new public rights-of-way and create blocks and lots; and

 

Whereas, The Department of Public Works has been authorized and directed to prepare a coordinated report estimating all costs and benefit assessments that will be incurred with said vacation; and

 

Whereas, Said vacation has been reviewed in accordance with Section 308-28, Milwaukee Code of Ordinances; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that said portion of street as indicated by Exhibit A and bound and described by:

 

That part of North Water Street in the Southeast 1/4 of Section 20, Township 7 North, Range 22 East, described as follows:

 

Commencing at the intersection of the present north line of East Knapp Street and the present west line of North Water Street; thence North 00 deg. 10 min. 59 sec. East, along said present west line, 70.041 feet to a point of curve and the point of beginning of the land to be described; thence Northeasterly, 112.834 feet along the arc of said curve which has a radius of 508.00 feet with its center lying to the southeast having a central angle of 12 deg. 43 min. 34 sec. and whose chord bears North 06 deg. 32 min. 46 sec. East, 112.602 feet to a point; thence North 00 deg. 10 min. 59 sec. East, parallel to said present west line, 64.755 feet to a point in the northeasterly extension of the present easterly line of North Edison Street; thence South 36 deg. 56 min. 47 sec. West, along said northeasterly extension, to its point of intersection with the present west line of North Water Street; thence South 00 deg. 10 min. 59 sec. West, along said present west line, to the point of beginning, is vacated; and, be it

 

Further Resolved, That this vacation is necessary for approval of a final subdivision plat known as Park East on the East Side of the Milwaukee River, which dedicates public rights-of-way and creates blocks and lots; and, be it

 

Further Resolved, That upon deposit of the funds required, the Commissioner of Public Works and/or the City Engineer are authorized to implement actions listed in the coordinated report relating to said vacation; and, be it

 

Further Resolved, That as provided by Section 80.32(4), Wisconsin Statutes, said vacation shall not terminate the easements and rights incidental thereto acquired by or belonging to any county, town, village or city, or to any utility or person in any underground structures, improvements or services, as enumerated or otherwise existing in said description of land above described, both easements and rights and all rights of entrance, maintenance, construction and repair with reference thereto shall continue as if said portion of street had not been vacated.
