Original resolution authorizing the Commissioner of Public Works to execute an Agreement between the City of Milwaukee and Milwaukee County for the maintenance of bioswales in the medians of West Hampton Avenue (CTH EE) between North 107th Street and approximately North Swan Blvd, in the 5th Aldermanic District.

 

Analysis

This original resolution authorizes the Commissioner of Public Works to execute a document titled Agreement for Maintenance or other Roadside Landscaping within Milwaukee County Trunk Highway (CTH EE) Right of Way - Agreement No. 2020EE1 between the City of Milwaukee and Milwaukee County for the maintenance of nine bioswales. The bioswales are located in the medians of West Hampton Avenue (CTH EE) between North 107th Street and approximately North Swan Blvd

 

Body

Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and

 

Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and

 

Whereas, The City proposes to construct nine bioswales in the medians of West Hampton avenue (CTH EE) between North 107th Street and  approximately North Swan Blvd, which is under the jurisdiction of Milwaukee County (County); and

 

Whereas, In order to establish the terms and conditions for the maintenance and ownership of the bioswales, the City and the County desire to enter into an Agreement, and

 

Whereas, The County has prepared a document titled Agreement for Maintenance or other Roadside Landscaping within Milwaukee County Trunk Highway (CTH EE) Right of Way - Agreement No. 2020EE1which stipulates that the City will retain ownership of the bioswales and of the associated facilities and shall also receive the total amount of the Total Suspended Solids (TSS) reduction credits; and

 

Whereas, Said Agreement also outlines that the City will maintain in good condition the bioswales including the vegetation and all associated facilities to ensure proper functionality, now, therefore, be it;

 

Resolved, That the Commissioner of Public Works is authorized to execute said Agreement between the City and the County regarding the maintenance of the bioswales in the medians of West Hampton avenue (CTH EE) between North 107th Street and approximately North Swan Blvd, said Agreement being attached to this Common Council Resolution File Number ----200364 in substantially the same form and substance as submitted, and to effectuate the intent of this resolution.
