Currently, the chief of police must make and complete an investigation of the statements made in a direct seller license application within 10 days following referral of the application by the city clerk. This ordinance removes the 10-day time limit for conducting an investigation. In addition, the ordinance requires that each license applicant be fingerprinted by the police department as part of the police background investigation.
BODY:
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1. Section 95-1-2-g of the code is repealed and recreated to read:
 
95-1. Direct Sellers.
 
2.      DEFINITIONS.
 
g.      "Person" means a natural person.
 
Part 2. Section 95-1-4-d of the code is renumbered 95-1-4-e.
 
Part 3. Section 95-1-4-d of the code is created to read:
 
4.      APPLICATION.
 
d. Fingerprinting. d-1. Each new applicant for a direct seller license shall be fingerprinted by the police department.
 
d-2. The requirement that an applicant be fingerprinted shall not apply to a person already licensed by the city when that person is renewing the license.
 
d-3. If a set of fingerprints is on file with the police department, an additional set shall not be required unless expressly requested by the police department.
 
Part 4. Section 95-1-5 of the code is amended to read:
 
5. INVESTIGATION. a. Upon receipt of each application, the clerk shall refer it immediately to the chief of police who shall make and complete an investigation of the statements made in such application [[as soon as possible, but no later than 10 days following referral]].
