Title

Resolution authorizing the Commissioner of Public Works to execute Project Agreements titled “State Municipal Agreement for Congestion Mitigation & Air Quality Projects” with the Wisconsin Department of Transportation and to set up design engineering at a total estimated cost of $281,950 with an estimated City of Milwaukee share of $56,390, and a grantor share of $225,560 for one project.

Analysis

This resolution authorizes the Commissioner of Public Works to execute a Project Agreement with the Wisconsin Department of Transportation for the planning, design and construction of a Congestion Mitigation & Air Quality project. This resolution also directs the City of Milwaukee Comptroller to transfer funds and establish project grant chartfield values for the planning and preliminary engineering for this project. The Project Agreement provides for 80 percent Federal aid and 20 percent local funds. The total estimated cost of the project is $1,818,550 with a grantor share of $1,454,840, a City share of $56,390, and a Milwaukee County share of $307,320. The total estimated planning and preliminary engineering cost for the project is $281,950, with a grantor share of $225,560 and a City share of $56,390. Construction funds for this project will be included in future resolutions.

Whereas, the project agreement has been requested and received from the Wisconsin Department of Transportation to be executed by the City of Milwaukee for programming, planning, design and construction of the following project under the Congestion Mitigation & Air Quality program:

Whereas, The Department of Public Works shall notify the Common Council of the City of Milwaukee of project cost overruns and changes in scope approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be 100 percent liable for project cost overruns and changes in scope as approved by the Department of Public Works; and

 

Whereas, The Common Council of the City of Milwaukee recognizes that the City may be liable for any costs incurred by the State should the City decide to withdraw from the project; and

 

Whereas, Construction on the project is currently scheduled to start in 2026-2028; and

 

Whereas, Construction funds for the project will be included in a separate resolution; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the Commissioner of Public Works is hereby authorized to execute the Project Agreement for the programming, planning, design, and construction of the aforementioned project with Federal aid under the Congestion Mitigation & Air Quality program, a copy of which is attached to and incorporated in this resolution by reference as though set forth in full; and, be it

 

Further Resolved, That the proper City of Milwaukee official is hereby directed to undertake preliminary engineering for the above-mentioned project which is anticipated to begin in 2025 and to reimburse the Wisconsin Department of Transportation for preliminary engineering costs they incur for the improvements; and, be it

 

Further Resolved, That the Commissioner of Public Works is hereby directed to undertake, or engage a consultant to undertake, all or part of the engineering for the improvement of the aforementioned project and to reimburse the Wisconsin Department of Transportation for the design engineering costs as they occur for the improvements; and, be it

 

Further Resolved, That minor changes to the agreement which do not change its intent are hereby approved; and, be it

 

Further Resolved, That the City Comptroller is hereby authorized to create within the Capital Improvement Fund, Grant and Aid Projects, the necessary Project Grant Chartfield Values for design engineering for the project (Expenditure) and transfer to any of these accounts the amount required under the grant agreement and the City Accounting Policy but not to exceed a 10 percent increase of the total amounts reserved for the grantor’s share and local share or $5,000, whichever is greater, as follows:
