Analysis
This ordinance provides that a person whose permanent residence is in another state but who temporarily resides in the city may be issued the following types of parking permits if the person possesses and provides proof of a valid driver’s license from the state of permanent residence and currently-valid motor vehicle registration in the state of permanent residence, as well as proof of temporary residency in the city:
1. Residential daytime parking privilege permit for a nonconforming residential use.
2. Residential daytime parking privilege permit for a commuter parking impacted area.
3. Resident-only parking permit for a resident-only parking zone within the University of Wisconsin-Milwaukee commuter parking impacted area.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
Part 1. Section 81-86 of the code is repealed and recreated to read:
81-86. Parking Permit: On-Street Daytime Residential. The fee for each annual on-street, daytime residential parking permit shall be $15, except that the fee for each annual on-street, daytime residential parking permit issued to an applicant who qualifies for a permit under s. 101-27.5-3.5 shall be $95.

Part 2. Section 81-87 of the code is amended to read:
81-87. Parking Permit: On-Street Commuter Parking, Impacted Areas. There shall be no fees charged for on-street commuter parking permits for impacted areas issued on an annual basis >>, except that the fee for each annual on-street commuter parking permit issued to an applicant who qualifies for a permit under s. 101-27.7-8-b-2 shall be $95<< .

Part 3. Section 101-27.5-3.5 of the code is created to read:
101-27.5. Residential Daytime Parking Privilege for Nonconforming Residential Uses.
3.5. Notwithstanding the provisions of sub. 3, a resident of another state who resides temporarily in the city, who possesses a valid driver’s license from the other state, whose vehicle has current, valid registration in the other state, and who is able to provide proof of temporary residency in the city may obtain a permit if the person’s permit application contains the person’s name, the person’s temporary address in Milwaukee, the person’s permanent address in the other state, the license number on the person’s driver’s license from the other state, and the make, model and registration number of each vehicle. At the time of application, the applicant shall present a current and valid motor vehicle registration from the other state for each vehicle listed on the application, as well as a valid out-of-state driver’s license with the same permanent address as that stated on the application. Each vehicle shall have valid motor vehicle license plates from the applicant’s state of permanent residence. Temporary plates issued by the state of permanent residence are valid and it is the responsibility of the permit applicant to request a plate change if different plates are issued. Permits will not be issued for vehicles without current license plates.
Part 4. Section 101-27.5-10 of the code is created to read:
10. A permit holder may be issued, at the sole discretion of the commissioner of public works, a physical permit to be displayed on the vehicle named in the permit application, or a paperless permit solely held by and on file with the department of public works.
Part 5. Section 101-27.7-8-b-2 to 4 of the code is renumbered 101-27.7-8-b-3 to 5.
Part 6. Section 101-27.7-8-b-2 of the code is created to read:
101-27.7. Residential Daytime Parking Privilege for Commuter Parking Impacted Areas.
8. APPLICATION AND PERMIT.
b. Application and Permit Information.
b-2. Notwithstanding the provisions of subd. 1, a resident of another state who resides temporarily in the city, who possesses a valid driver’s license from the other state, whose vehicle has current, valid registration in the other state, and who is able to provide proof of temporary residency in the city may obtain a permit if the person’s permit application contains the person’s name, the person’s temporary address in Milwaukee, the person’s permanent address in the other state, the license number on the person’s driver’s license from the other state, and the make, model and registration number of each vehicle. At the time of application, the applicant shall present a current and valid motor vehicle registration from the other state for each vehicle listed on the application, as well as a valid out-of-state driver’s license with the same permanent address as that stated on the application. Part 7. Section 101-27.7-8-b-3 of the code is amended to read:
b-2. The permit >>record<< shall [[display]] >>contain<< the hundred block, directional and street name of the applicant’s residence, the date of issuance, expiration date, and permit number, along with the license number, make and year of each car and the commuter parking impacted area in which the permit holder resides.
Part 8. Section 101-27.7-11-g of the code is created to read:
11. RESIDENT-ONLY PAKRING PERMIT.
g. Form of Permit. A permit holder may be issued, at the sole discretion of the commissioner of public works, a physical permit to be displayed on the vehicle named in the permit application, or a paperless permit solely held by and on file with the department of public works.
